1. About these terms

These terms apply to your use of vertigras.com (the “website”), operated by Vertigras (Pty) Ltd (registration number 2024/227320/07) (“Vertigras”, “we”, “us”). By using the website, you agree to them.

2. Using this website

The website gives information about Vertigras and our apps. You may use it for lawful, personal and informational purposes. You may not try to disrupt it, gain unauthorised access to it or the systems behind it, or use it in a way that breaks any law.

3. Our apps

Our apps, including Skedaddle and TomeVox, are distributed through the Microsoft Store. When you obtain an app there, your use of it is licensed under the Microsoft Store’s standard application licence terms, unless the app’s Store listing names other terms.

Our apps are intended for people aged 18 and older, in line with their Store age ratings.

Free trials and subscriptions. Our apps each start with a free trial, followed by a paid subscription billed monthly or annually. Current prices are shown on each app’s Store listing. Subscriptions are bought through the Microsoft Store, and payment, renewals, cancellations, the end of a free trial and refunds are handled by Microsoft under its own terms. If you don’t want a subscription to start when your trial ends, cancel it in your Microsoft account before then. We may change our prices or plans; a change will not affect a period you have already paid for.

Accounts. Our apps require an account. Please keep your password safe; you are responsible for activity under your account, and you should tell us straight away at admin@vertigras.com if you think someone else has access to it. We may suspend an account that is used to break the law or these terms. You can ask us to delete your account at any time, as described in our privacy policy.

4. Intellectual property

The website, our apps, the names Vertigras, Skedaddle and TomeVox, and our logos are owned by Vertigras. You may not copy, modify or redistribute them except as the law or the relevant licence allows.

5. Provided as is

We work hard to keep the website accurate and available, but it is provided “as is” and “as available”. We do not guarantee that it will always be error-free or uninterrupted. Information about apps in development, including features and release timing, may change.

6. Limitation of liability

To the extent the law allows, Vertigras is not liable for any indirect or consequential loss arising from your use of the website. Nothing in these terms limits any right you have under the Consumer Protection Act, 68 of 2008, or any other law that cannot be excluded.

7. Privacy

How we handle personal information is explained in our privacy policy. The website itself uses no cookies, analytics or tracking.

8. Governing law

These terms are governed by the laws of the Republic of South Africa.

9. Changes

We may update these terms from time to time. The date at the top shows when they last changed, and the current version is always on this page.
